# Why window replacement permits fail

Window permits fail when a bedroom window no longer meets the egress opening, when glass near doors, stairs or tubs is not tempered and marked, when the windows exceed the energy code's U-factor, or when a historic property skips its design approval. A missing floor plan, no flashing or no working smoke and carbon monoxide alarms at the final can also stop it.

## Key facts

- New egress windows need at least 5.7 square feet of net clear opening (5.0 at grade level), a 20-inch clear width, a 24-inch clear height and a sill no more than 44 inches above the floor.[^1][^3]
- Bloomington adds glass within 5 feet of the bottom of a stairway and less than 36 inches above the landing, and glass in bathing areas less than 5 feet above the drain.[^2]
- Inver Grove Heights applies the same 0.32 cap and a 0.55 cap for skylights.[^4]
- In Littleton, Colorado, any window replacement needs a building permit, and properties on the Littleton Historic Register also need a Certificate of Appropriateness before a window is replaced; the project must meet approval criteria that include the Secretary of the Interior's Standards.[^5]
- Firms doing that work in homes built before 1978 must be EPA- or state-certified and use certified renovators who follow lead-safe work practices, under the EPA's Renovation, Repair and Painting Rule.[^6]

## Why do window replacement permits fail?

A window permit is reviewed on paper and then at your house. These are the items city handouts list for replacement windows:

| Problem | The rule | Source |
| --- | --- | --- |
| Bedroom window too small | 5.7 sq ft net opening (5.0 at grade), 20 in wide, 24 in high, sill 44 in max, unless the replacement exception applies | Culver City[^1]; Woodland[^3] |
| Wrong replacement size | The exception requires the manufacturer's largest standard size that fits the existing frame or rough opening | Culver City[^1]; Bloomington[^2] |
| Glass not tempered where required | Near doors, stairs, tubs and showers, and large low panes near walkways | Culver City[^1]; Bloomington[^2] |
| Tempered but not marked | A permanent manufacturer's mark; stickers are not sufficient | Woodland[^3] |
| U-factor too high | 0.32 maximum in Bloomington and Inver Grove Heights, Minnesota; 0.27 on Roseville's 2025 form for California climate zone 11 | Bloomington[^2]; Inver Grove Heights[^4]; Roseville[^9] |
| No flashing | Installed per the manufacturer, with new flashing | Culver City[^1]; Inver Grove Heights[^4] |
| Alarms missing at final | Smoke and carbon monoxide alarms installed and working | Bloomington[^2]; Inver Grove Heights[^4] |
| Historic property without approval | Certificate of Appropriateness before replacement | Littleton, Colorado[^5] |

## 1. The bedroom window got smaller

This is the one with real consequences, because a bedroom window is a way out in a fire. New egress windows need at least 5.7 square feet of net clear opening (5.0 at grade level), a 20-inch clear width, a 24-inch clear height and a sill no more than 44 inches above the floor[^1][^3].

Replacements have an exception, and it is narrow: the new window must be the manufacturer's **largest standard size** that fits the existing frame or rough opening, in the same operating style or one that opens at least as wide[^1][^2]. Order a smaller insert to make installation easier, or swap a casement for a style that opens less, and the exception no longer covers you. Bloomington reminds homeowners that on double-hung windows, the clear height is measured on the lower sash only[^2]. Minnesota cities add two more conditions: the room must not be used for a state-licensed purpose requiring an egress window, and the window must not be required to be replaced under a local rental housing code[^4].

## 2. The glass by the door

Safety glazing rules are specific, and a whole-house order can easily include a pane that falls under one. Culver City requires tempered glazing within a 2-foot arc of either edge of a door where the bottom edge of the glass is less than 60 inches above the walking surface, near stair landings, beside stairs where the glass is less than 36 inches above the walking surface, and in walls enclosing a tub or shower[^1]. Bloomington adds glass within 5 feet of the bottom of a stairway and less than 36 inches above the landing, and glass in bathing areas less than 5 feet above the drain[^2].

Then the inspector looks for proof. Woodland requires tempered glazing to be identified by a permanent manufacturer's mark that cannot be removed without being destroyed, such as sandblasted, acid etched, ceramic fired, laser etched or embossed; stickers are not sufficient[^3].

## 3. The energy numbers

The label on the window has to match the code. Bloomington caps the U-factor at 0.32 and clarifies that a 0.37 window would not comply while a 0.30 window is better[^2]. Inver Grove Heights applies the same 0.32 cap and a 0.55 cap for skylights[^4]. In California, the 2025 Energy Code applies to permit applications filed on or after January 1, 2026[^8]; Roseville's 2025 window-replacement form for climate zone 11 lists a 0.27 U-factor and a 0.23 solar heat gain coefficient from Table 150.1-A[^9]. A window ordered to the numbers of an older handout can fail review.

## 4. The historic district

If your house is designated, the building permit is the second approval, not the first. In Littleton, Colorado, any window replacement needs a building permit, and properties on the Littleton Historic Register also need a Certificate of Appropriateness before a window is replaced; the project must meet approval criteria that include the Secretary of the Interior's Standards[^5]. Littleton treats repair of historic windows as the first consideration and approves replacement when the windows are truly beyond repair and the criteria are met[^5]. When everything is in order, staff can approve administratively with no public hearing[^5].

## 5. Lead-safe work in pre-1978 homes

Window replacement in an older house disturbs painted surfaces. Firms doing that work in homes built before 1978 must be EPA- or state-certified and use certified renovators who follow lead-safe work practices, under the EPA's Renovation, Repair and Painting Rule[^6]. Inver Grove Heights asks contractors working on pre-1978 homes for their lead certification number on the permit application[^4]. A contractor without one is a problem on the application, not only on the job.

## 6. The final inspection

Even a perfect window can fail a final. Bloomington requires smoke and carbon monoxide alarms to be installed and working at the final inspection, and someone 18 or older must give the inspector access to the inside[^2]. Inver Grove Heights requires smoke detectors in all bedrooms, in hallways leading to them and on every level, and carbon monoxide alarms within 10 feet of all bedrooms[^4]. The permit is for the windows; the inspection looks at the house.

## Skipping the permit

Window work done without a required permit is still work without a permit. In New York City, legalizing work done without a permit on a one- or two-family home carries a $600 civil penalty, and removing it instead carries the same penalty[^7]. A replacement bedroom window that no longer meets egress is also a life-safety defect, permit or no permit.

## How to pass the first time

1. **Measure every bedroom window's net clear opening** before you order, and order the largest standard size that fits.
2. **Mark the hazardous locations** on a floor plan: doors, stairs, tubs, large low panes.
3. **Check the U-factor** against your city's limit, for the size of your whole job.
4. **Check the historic map** and the year your house was built.
5. **Test your smoke and CO alarms** before the final.

The **All-in, until approved** offer ($399) prepares this for your address: the rule that applies, a window schedule checked for egress, safety glass and energy, the floor plan and forms, a review before you file and our follow-up until the permit is issued. If the city refuses it for a written requirement we should have caught, the [guarantee](https://yespermit.com/guarantee/) applies.

## Common questions

### Why did my replacement window fail inspection?

The items city handouts check include an egress window that is too small for a bedroom, glass that should be tempered and is not, a U-factor above the energy code limit, missing flashing, and smoke or carbon monoxide alarms not installed or not working at the final inspection.

### Can a historic commission refuse my new windows?

Yes, where your property is designated. In Littleton, Colorado, properties on the historic register need a Certificate of Appropriateness before a window can be replaced, and projects must meet approval criteria that include the Secretary of the Interior's Standards.

### Is a sticker enough to show glass is tempered?

Not in Woodland, California. Its handout says tempered glazing must carry a permanent manufacturer's mark, such as sandblasted, acid etched, ceramic fired, laser etched or embossed, and that stickers are not sufficient.
