# Inground pool permits, explained

Yes. An inground swimming pool needs a building permit almost everywhere, usually with separate electrical and plumbing permits. The model code only exempts prefabricated pools less than 24 inches deep. Expect a site plan with setbacks, pool and barrier drawings, an electrical bonding plan, several inspections, and a code-compliant fence and gate before you fill it.

## Key facts

- The only pool the model International Residential Code (IRC) exempts is a prefabricated swimming pool less than 24 inches deep.[^1]
- San Diego states that all in-ground swimming pools require a permit, and Columbia, South Carolina, requires a swimming pool permit for all residential in-ground and permanent above-ground pools.[^2][^5]
- Chicago requires a fence or wall at least 5 feet high around the pool deck, and Pleasanton, California, a minimum 60-inch enclosure.[^3][^6]
- Columbia lists them in order: Site and location, to confirm placement and setbacks; Structural or pre-concrete, the steel and the forms; Pool bonding, before the gunite or backfill; Equipotential, or perimeter, bonding, before the deck is poured; Barrier and fence, before the pool is filled; Final.[^5]
- On a $60,000 pool, Germantown's valuation fee works out to $698.40 before plan review, the record maintenance and zoning fees, and the other trade permits.[^11]

## Do you need a permit for an inground pool?

Yes. The only pool the model International Residential Code (IRC) exempts is a prefabricated swimming pool less than 24 inches deep[^1]. Cities say it even more directly: San Diego states that all in-ground swimming pools require a permit[^2], and Columbia, South Carolina, requires a swimming pool permit for all residential in-ground and permanent above-ground pools[^5]. In Chicago, a private residential pool deeper than 48 inches needs a full building permit based on plans prepared by a licensed architect or structural engineer[^3].

The reason is not paperwork for its own sake. The U.S. Consumer Product Safety Commission reports that an average of 376 children under 15 fatally drowned in pool- or spa-related incidents each year from 2021 to 2023, nearly 80 percent of them under five, and that over 70 percent of those deaths happened in residential settings[^12]. Barriers, gates and alarms are what the pool permit checks most closely.

## Usually more than one permit

A pool is structure, plumbing and electricity in the ground, and many cities split them:

- **Building permit** for the pool shell, the deck and often the barrier. Columbia notes that the barrier may require a separate fence permit[^5].
- **Electrical permit** for the pump, lights, heater and bonding. Midland, Michigan, warns that electrical and mechanical permits may be required in addition to the building permit[^4]; Chicago requires one for any permanent electrical connection other than a cord-and-plug[^3].
- **Plumbing permit** for any permanent water connection, as in Chicago[^3].

## What the application includes

| Document | What it shows | Example |
| --- | --- | --- |
| Site plan | Property lines, pool location, setbacks, barrier | Columbia[^5]; Chicago adds overhead and underground electric lines, sewer and water lines, from a legal survey[^3] |
| Pool drawings | Plan and sections, volume and surface area | Chicago[^3] |
| Bonding diagram | Steel, water and equipment tied into one equipotential grid, deck included | Columbia: conductive surfaces within 5 feet of the pool wall[^5] |
| Plumbing schematic | Filling, backwash, discharge, disinfection, filter | Chicago[^3] |
| Barrier details | Fence, gates, latches, house wall doors | Columbia[^5]; Chicago fence detail[^3] |

## Barrier and alarm rules

These are the rules inspectors check before water goes in. Under the International Swimming Pool and Spa Code barrier requirements summarized by Des Moines, Iowa[^7]:

- the barrier is at least **48 inches** high, measured on the side away from the pool, with no more than **2 inches** between the ground and the bottom;
- no opening lets a **4-inch ball** pass;
- pedestrian gates **open outward** from the pool and are **self-closing and self-latching**, with the release at least 54 inches up or on the pool side at least 3 inches below the top;
- where the house wall is part of the barrier, the pool needs a powered safety cover, door and window alarms, or another approved protection.

Some places go further. Chicago requires a fence or wall at least 5 feet high around the pool deck[^3], and Pleasanton, California, a minimum 60-inch enclosure[^6]. Pleasanton also requires a new or remodeled pool at a single-family home to have at least two of seven drowning prevention features, such as an enclosure isolating the pool from the house, a safety cover, exit alarms or pool alarms, working at the final inspection[^6].

## Setbacks and overhead wires

| City | Distance rules |
| --- | --- |
| Midland, Michigan | Side or rear yard only; 3 feet from property lines and 6 feet from other structures in a rear yard; never in an easement; overhead wiring at least 22.5 feet above the water[^4] |
| New York City | 5 feet from any lot line on lots 25 feet wide or more, 3 feet from side lot lines on narrower lots; no overhead conductors within 22.5 feet; 4-foot fence with a self-closing gate[^8] |
| Chicago | 10 feet from any neighboring lot or alley, equipment too; overhead wiring generally not within 10 feet horizontally of the pool edge[^3] |

## The inspections

Expect several site visits. Columbia lists them in order[^5]:

1. Site and location, to confirm placement and setbacks;
2. Structural or pre-concrete, the steel and the forms;
3. Pool bonding, before the gunite or backfill;
4. Equipotential, or perimeter, bonding, before the deck is poured;
5. Barrier and fence, before the pool is filled;
6. Final.

Pleasanton requires the enclosure to be installed and working before any water is introduced, typically at its pre-plaster inspection, and the two drowning prevention features to be working at the final[^6].

## What an inground pool permit costs

| Place (2026) | Published fee |
| --- | --- |
| Pleasanton, California | $865 fixed for a pool or in-ground spa at a one- or two-family home, trade fees included[^9] |
| Lower Salford Township, Pennsylvania | $405 for an in-ground pool, $255 for an above-ground pool, plus decking fees[^10] |
| Germantown, Wisconsin | $11.64 per $1,000 of valuation for the pool with deck and fence, electrical and plumbing extra, plus a $42.32 plan review fee and the property record maintenance and zoning compliance fees[^11] |
| Midland, Michigan | In-ground pools by project valuation; above-ground pools $78[^4] |

On a $60,000 pool, Germantown's valuation fee works out to $698.40 before plan review, the record maintenance and zoning fees, and the other trade permits[^11]. Lower Salford doubles its fees if work starts without an approved permit[^10]. Your permit file shows your own city's fees, with the link.

> **Where we stop**
> We prepare the permit file for your pool: your city's pool, barrier and setback rules with the code sections, the site plan with every distance and utility line, and the barrier and gate details. Pool shells, structural design and electrical bonding plans are drawn by your pool contractor or a licensed professional, and some cities, like Chicago, require an architect or engineer.

## Before you sign with a pool builder

Ask who pulls the permits and which ones, and get the barrier plan in writing: it is the part of the project that protects children, and the part every inspection checks. The All-in offer prepares the homeowner's side of the file and follows the city's comments until approval.

## Common questions

### Do you need a permit for an inground pool?

Yes, in practice everywhere. San Diego states that all in-ground swimming pools require a permit, Columbia, South Carolina, requires a swimming pool permit for all residential in-ground and permanent above-ground pools, and Chicago requires a full building permit based on plans by a licensed architect or structural engineer.

### How tall does a pool fence have to be?

At least 48 inches under the barrier rules Des Moines and Midland, Michigan, enforce from the International Swimming Pool and Spa Code; some cities ask for more, such as 5 feet in Chicago and 60 inches in Pleasanton, California. Gates must be self-closing and self-latching.

### How far does a pool have to be from the property line?

It depends on the city. Midland, Michigan, asks for 3 feet from property lines and 6 feet from other structures, New York City for 5 feet from any lot line on lots 25 feet wide or more, and Chicago for 10 feet from any neighboring lot or alley.

### How much does an inground pool permit cost?

Fees are local. In 2026, Pleasanton, California, charges a fixed $865 for a residential pool or in-ground spa, trade fees included, and Lower Salford Township, Pennsylvania, charges $405 for the pool plus decking fees.

### Can I fill the pool before the final inspection?

Not before the barrier is approved. Columbia, South Carolina, inspects the barrier before the pool is filled, and Pleasanton, California, requires the enclosure to be installed and working before any water goes in.
