# What happens if you build without a permit

Building without a required permit can trigger a stop-work order, an investigation fee or penalty on top of the normal permit fee, an order to legalize or remove the work, and problems when you sell or insure the house. The work is not grandfathered: it stays unpermitted until it is inspected and approved, even after a sale.

## Key facts

- Washoe County, Nevada, puts it bluntly: work done without required permits violates the county's ordinances and building code and "is considered by default to be illegally constructed work".[^5]
- In Santa Clarita, California, stop-work orders are issued for unpermitted construction or for construction that violates the city's zoning or building codes, and they require you or your contractor to stop all construction work immediately.[^1]
- New York City also doubles the civil penalties for a second or subsequent work-without-a-permit violation within one year of the last one.[^4]
- Turlock, California, notes that owners sometimes decide it is easier and more cost-effective to simply remove the unpermitted work.[^6]
- Fairfax County, Virginia, applies its unpermitted construction rules to properties that have been bought and sold to new owners, regardless of when the construction was done.[^7]

## What does the city do when it finds unpermitted work?

A permit is not a formality the city forgets about. When work that needs a permit is built without one, the building department has a set of tools, and each of them costs you money, time or both. Washoe County, Nevada, puts it bluntly: work done without required permits violates the county's ordinances and building code and "is considered by default to be illegally constructed work"[^5].

Here is what that means in practice, step by step, with real rules from real cities.

## 1. A stop-work order

If an inspector sees work going on without a permit, the first thing you get is usually an order to stop. In Santa Clarita, California, stop-work orders are issued for unpermitted construction or for construction that violates the city's zoning or building codes, and they require you or your contractor to stop all construction work immediately[^1].

Ignoring it makes things worse. Santa Clarita states that if work continues after a stop-work order, the property owner is subject to fines and a lien placed on the property[^1]. The way out is the permit itself: once it is issued, an inspector can visit the site and lift the order[^1].

> **Half-finished is the worst moment**
> A stop-work order often lands when the project is open: footings dug, framing up, materials on site. Every week of delay costs you while the permit is being prepared after the fact.

## 2. Do you pay more for a late permit?

Getting the permit late can cost more than getting it first. Cities publish these surcharges in their fee schedules:

| City | What it adds when work started before the permit | Source |
| --- | --- | --- |
| Miami Lakes, Florida | An extra 100% of the permit fee plus $100 on a first offense; twice the double fee plus $200 on a second | Fee schedule[^2] |
| New York City | A $600 civil penalty to legalize unpermitted work on a one- or two-family home ($6,000 on other buildings) | DOB Form L2[^3] |

New York City also doubles the civil penalties for a second or subsequent work-without-a-permit violation within one year of the last one[^4]. And Miami Lakes adds that paying the extra fee does not relieve the applicant of other penalties established by law[^2].

## 3. Legalize it, or take it down

Paying the penalty does not close the file. The work still has to be legalized: inspected, sometimes opened up, and brought to code. Washoe County explains that applying to legalize existing work is the same as applying for new work, and that concealed work must either be exposed for inspection or certified by a licensed professional[^5].

Some work can never be legalized. Washoe County lists projects that may be denied a permit, such as setback violations or work located in drainage ways or easements, and says a demolition permit may be required to bring the property into compliance[^5]. Turlock, California, notes that owners sometimes decide it is easier and more cost-effective to simply remove the unpermitted work[^6].

Removal is not free either: in New York City, removing work that was done without a permit carries the same $600 penalty on a one- or two-family home, even if the removal itself did not need a permit[^3].

## 4. It follows the house when you sell

Unpermitted work does not expire. Fairfax County, Virginia, applies its unpermitted construction rules to properties that have been bought and sold to new owners, regardless of when the construction was done[^7]. Washoe County reminds owners that Nevada's disclosure laws require illegal work to be declared before a sale[^5].

New York City shows the other side: a buyer who proves that the work was done by a previous owner can ask for a waiver of the doubled penalty as a bona fide purchaser[^4]. In other words, the buyer inherits the file. More on this in [unpermitted work when selling a house](https://yespermit.com/guides/unpermitted-work-when-selling-a-house/).

## 5. Insurance and value

Washoe County also lists two quieter costs: illegal construction can affect your home's insurability, and legalizing the work lets its value count in property value calculations[^5]. Whether a claim is paid depends on your policy; we explain what the official sources say in [does homeowners insurance cover unpermitted work](https://yespermit.com/guides/does-insurance-cover-unpermitted-work/).

## The cheaper path: the permit first

Every cost on this page starts with the same missing document. A permit applied for before the work starts costs the normal fee, gets inspected while the work is still open, and leaves a clean record for the day you sell. Virginia law, as Fairfax County summarizes it, requires both permits and passed inspections[^7].

## Common questions

### Can the city make me tear down something I built without a permit?

It can come to that. Washoe County, Nevada, warns that some unpermitted work cannot be permitted at all, for example work that violates setbacks or sits in drainage ways or easements, and that a demolition permit may then be needed to bring the property into compliance. Turlock, California, notes that some owners find it easier and cheaper to remove the work.

### How much more does a permit cost if I already started?

It depends on the city. In Miami Lakes, Florida, work started before the permit costs an extra 100% of the permit fee plus $100 the first time. In New York City, legalizing unpermitted work on a one- or two-family home carries a $600 civil penalty.

### What if the previous owner built it without a permit?

The problem usually comes with the house. Fairfax County, Virginia, applies its unpermitted construction rules to homes that were bought and sold, regardless of when the work was done. New York City lets a buyer who can show the work was done by a previous owner ask for a waiver of the doubled penalty.

### What happens if I keep working after a stop-work order?

In Santa Clarita, California, a property owner who continues work after a stop-work order is subject to fines and a lien on the property. The order is lifted once a permit is issued and an inspector visits.
