# Unpermitted work when selling a house

Several states make sellers answer directly about permits. California's transfer disclosure statement asks about additions or alterations made without necessary permits, the Texas seller's disclosure notice asks the same, and Washington's form asks whether all building permits and final inspections were obtained. Answering yes can cost the sale; answering no falsely creates legal risk.

## Key facts

- Washoe County reminds owners that Nevada's disclosure laws require illegal work to be declared before a sale.[^4]
- In Washington the timing is written into the form itself: the statement tells the buyer that, unless otherwise agreed in writing, they have three business days from delivery of the disclosure statement to rescind the agreement.[^3]
- Washington's form, says the disclosures are based on the seller's actual knowledge at the time the seller completes the statement.[^3]
- Fairfax County, Virginia, applies its unpermitted construction rules to properties that have been bought and sold to new owners, regardless of when the construction was done.[^5]
- New York City even has a procedure built for this situation: a buyer who proves that work without a permit was performed by a previous owner can ask for a waiver of the doubled civil penalty as a bona fide purchaser.[^6]

## Do you have to disclose unpermitted work when you sell?

In many states, yes, and the question is printed on the form. Seller disclosure forms are written by state law, and several of them ask about permits in plain words. You do not get to skip the line: you answer what you know, and you sign it.

Three examples, quoted from the official texts:

| State | What the seller is asked | Source |
| --- | --- | --- |
| California | Whether the seller is aware of "room additions, structural modifications, or other alterations or repairs made without necessary permits", and, separately, of work not in compliance with building codes and of zoning violations and violations of "setback" requirements | Transfer Disclosure Statement[^1] |
| Texas | Whether the seller is aware of "room additions, structural modifications, or other alterations or repairs made without necessary permits or not in compliance with building codes in effect at that time" | Seller's Disclosure Notice, TREC No. 55-1 (Property Code §5.008)[^2] |
| Washington | Whether there have been any conversions, additions or remodeling and, if so, whether all building permits and all final inspections were obtained | RCW 64.06.020[^3] |

Nevada is in the same family: Washoe County reminds owners that Nevada's disclosure laws require illegal work to be declared before a sale[^4].

> **Note the wording**
> California and Texas do not ask only about houses or additions. "Other alterations or repairs" covers a lot of what homeowners build: a deck bolted to the house, a converted garage, a patio cover. Washington asks about permits *and* final inspections: a permit that was opened but never passed its final inspection is not the same as an approved one.

## What happens if the answer is yes?

A yes is honest, and it changes the negotiation. The buyer now knows the work may need to be legalized, inspected, opened up or removed, and prices that in, asks for a credit, or walks away.

In Washington the timing is written into the form itself: the statement tells the buyer that, unless otherwise agreed in writing, they have three business days from delivery of the disclosure statement to rescind the agreement[^3]. A permit problem that appears on that form shows up exactly when the buyer can still leave.

## And if the seller says no?

The forms are signed statements of what the seller knows. Washington's form, for example, says the disclosures are based on the seller's actual knowledge at the time the seller completes the statement[^3]. Answering no about work you know was built without a permit is a false statement on a legal form. We are not lawyers: if you are unsure how to answer, ask a real estate attorney in your state before you sign.

## Does the problem go away after the sale?

No. Unpermitted work stays unpermitted. Fairfax County, Virginia, applies its unpermitted construction rules to properties that have been bought and sold to new owners, regardless of when the construction was done[^5].

New York City even has a procedure built for this situation: a buyer who proves that work without a permit was performed by a previous owner can ask for a waiver of the doubled civil penalty as a bona fide purchaser[^6]. The waiver is about the penalty; the work itself still has to be dealt with.

## How to fix it before you list

The cleanest answer on a disclosure form is "permits obtained, finals passed". For work already built, that means an as-built permit, sometimes called a legalization permit. Garden Grove, California, describes the usual steps[^7]:

1. **An investigation** of the site, with a written report on the unpermitted work and visible code violations.
2. **Plans** for the work to be legalized, including structural plans and calculations where needed.
3. **Plan review**, matched against the investigation report.
4. **Fees** under the city's fee schedule, with possible additional penalties.
5. **Inspections**, where the inspector may require opening walls, ceilings or other concealed areas.

Washoe County adds a practical option: when concealed work cannot reasonably be exposed, a licensed design professional or a contractor licensed in that discipline can certify in writing that it meets the currently adopted codes[^4].

Plan for time: an investigation, plans, review and inspections do not fit in the week before closing. Our guide to [getting a permit for work already built](https://yespermit.com/guides/permit-for-work-already-built/) goes through the process in detail.

## Building something new before you sell?

Then get the permit now, while it costs only the normal fee and the inspector can see the work open. It turns a future disclosure question into a clean "yes, permits and final inspections obtained".

## Common questions

### Do I have to disclose a deck or shed built without a permit?

In states whose disclosure forms ask about work done without permits, the question is not limited to big additions. California's form asks about room additions, structural modifications, or other alterations or repairs made without necessary permits. Texas uses almost the same wording. Read your state's form and answer what you actually know.

### Can a buyer back out because of unpermitted work?

In Washington, the seller disclosure statement itself tells the buyer they have three business days after delivery to rescind the agreement, unless the parties agree otherwise in writing. A permit problem revealed on that form arrives exactly in that window.

### Is unpermitted work grandfathered after a sale?

No. Fairfax County, Virginia, applies its unpermitted construction rules to properties bought and sold to new owners, regardless of when the work was done. The new owner inherits the file.

### Should I get a permit before listing the house?

Legalizing the work first replaces a yes on the disclosure form with an approved permit and passed inspections. Start early, because an as-built permit can require plans, inspections and sometimes opening walls.
