# Why gazebo permits get rejected

Gazebos are rarely refused for their structure. They fail on placement and zoning: too close to a lot line or the house, inside an easement or floodway, taller than the house, over the lot's accessory structure limits, not matching the house where a city requires it, or not anchored for the local wind. Each rule is published and can be checked first.

## Key facts

- Wheeling requires 6 feet from the side and rear lot lines and 10 feet from the principal building, and allows no structures in the front yard.[^1]
- Ramsey requires 5 feet from interior side and rear lot lines and keeps accessory structures no closer to the street than the house; it also sets distances from wells, pools, septic tanks and drain fields.[^2]

## Why was my gazebo permit rejected?

For a gazebo, the building review is usually short; the zoning review is where projects stop. These are the written rules behind most refusals:

| Reason | The rule | Example |
| --- | --- | --- |
| Too close to a lot line or the house | Minimum distances | Wheeling: 6 feet from side and rear lines, 10 feet from the house[^1]; Ramsey: 5 feet from interior lines[^2] |
| In the front yard | Accessory structures kept behind the house | Wheeling: no structures in the front yard[^1]; Ramsey: no closer to the street than the house[^2] |
| In an easement or floodway | No structures there | Wheeling[^1]; Plano: never in an easement or right-of-way[^4] |
| Too tall | Height capped by the house | Wheeling[^1]; Ramsey: house height or 24 feet[^2] |
| Too many or too much | Limits on number and area of accessory structures | Wheeling: one per lot in R-1 to R-3 besides a garage[^1]; Plano: coverage formulas[^4] |
| Doesn't match the house | Design matching above a size | Wheeling: 120 square feet or more[^1] |
| Not anchored | Wind anchoring required | Goose Creek: 140+ mph wind zone[^3]; Ramsey[^2] |

## The rules behind most refusals

### Setbacks, and the distance to the house

Gazebo setbacks are measured both ways: from the lot lines and from the house. Wheeling requires 6 feet from the side and rear lot lines and 10 feet from the principal building, and allows no structures in the front yard[^1]. Ramsey requires 5 feet from interior side and rear lot lines and keeps accessory structures no closer to the street than the house; it also sets distances from wells, pools, septic tanks and drain fields[^2]. A gazebo tucked into a back corner, or right next to the patio door, can break one of these.

### Easements and floodways

Easements are the quiet deal breaker. Wheeling allows no structures in an easement or floodway[^1]. Plano says that in no instance shall an accessory building be located within an easement or right-of-way[^4]. Ramsey lets small structures sit in a drainage and utility easement only if they are easily movable, do not impede the flow of water and have no permanent foundation, and keeps structures over 200 square feet out of any easement of record[^2]. A gazebo on a concrete slab is not easily movable.

Mapped flood zones bring federal rules in: communities in the flood insurance program must require permits for all proposed construction and other development within mapped Zone A areas[^6].

### Height, number and coverage

Wheeling caps a gazebo at the height of the house[^1]; Ramsey at the height of the house or 24 feet, whichever is less[^2]. Wheeling allows one accessory structure per lot in its R-1 to R-3 zones, in addition to a detached garage[^1], so a lot with a shed may have no room for a gazebo. Plano adds the area of gazebos, arbors and sheds to the garage and accessory buildings and caps the total share of the lot, at 45 percent on a standard single-family lot[^4]. Ramsey counts even small structures toward the allowed number and area[^2].

### Design matching

Some codes regulate the look. In Wheeling, an accessory structure of 120 square feet or more must match the house's color, building materials, roof materials and roof pitch unless the plan commission grants an exception[^1]. Ramsey asks detached accessory structures to generally match the house, including colors, soffit, fascia and eave overhangs[^2]. A cedar kit with a metal roof next to a brick house with shingles may need that exception.

### Attached is not a gazebo

Connect the gazebo to the house and it is reviewed as part of the house. Wheeling treats a breezeway connection as part of the principal building, subject to its lot coverage, setback and height requirements[^1]. Plano reviews attached covers as an addition to the house[^4].

### Wind and anchoring

Goose Creek, South Carolina, sits in a 140+ mph wind zone and requires every accessory structure to be securely fastened with an anchoring system, usually screw-type anchors and strapping per the manufacturer's instructions; without manufacturer's instructions, an architect or engineer must be consulted[^3]. Ramsey requires anchoring against high winds even for structures below the permit size[^2].

## What happens if you build it anyway

- **Removal.** Goose Creek states that any structure built without zoning approval will be required to be removed if it violates the zoning ordinance[^3].
- **Stop work, fines and a lien.** Santa Clarita can issue a stop work order for unpermitted construction, including gazebos over 120 square feet, with fines and a lien on the property if work continues[^5].
- **Extra fees.** Godfrey, Illinois, charges $250 for not obtaining a permit before construction starts[^7]; Bloomfield, Connecticut, charges an investigation fee of $250 or the permit fee, whichever is greater[^8].

## How to get it approved the first time

1. Draw the gazebo on your survey with every distance: lot lines, house, well, septic, pool[^1][^2].
2. Find the easements on your plat and stay out of them[^1][^4].
3. Count your existing accessory structures and their area[^1][^2][^4].
4. Check the height and matching rules before you buy a kit[^1][^2].
5. Plan the anchoring for your wind zone[^2][^3].

## How we can help

The All-in offer checks placement, easements, height and the accessory structure limits for your address before anything is drawn, then prepares the site plan, drawings or kit documents and forms, and follows the city's comments until approval. It includes our money-back guarantee if the city refuses the permit for a written requirement we should have caught; variances, neighbor objections and HOA decisions are not covered, as the guarantee page explains.

## Common questions

### Can a small gazebo be refused if it needs no permit?

Yes, by zoning. Ramsey, Minnesota, exempts structures of 200 square feet or less from the building permit but still requires them to meet height, size, setback and material rules, and Goose Creek, South Carolina, requires any structure built without zoning approval to be removed if it violates the zoning ordinance.

### Why can't my gazebo go in the utility easement?

Easements give utilities or the city the right to use that strip of your lot. Wheeling, Illinois, allows no structures in an easement or floodway, and Plano, Texas, says an accessory building may never be located within an easement or right-of-way.

### Why does the city care what my gazebo looks like?

Some codes require accessory buildings to match the house. In Wheeling, a structure of 120 square feet or more must match the house's color, materials, roofing and roof pitch unless the plan commission grants an exception, and Ramsey asks detached accessory structures to generally match the house's exterior.

### Can I have a gazebo and a shed?

Check the count. Wheeling allows one accessory structure per lot in its R-1 to R-3 zones in addition to a detached garage, and Ramsey limits the number and total area of accessory structures by lot size.
