# Why fire pit permits get refused

Published city rules point to location first: a fire pit closer than 25 feet to a structure or combustible material, inside a setback or an easement, or under branches. The other problems they name are a pit wider than 3 feet, a gas line without a piping diagram or listed burner, and wood burning where the local air district bans it.

## Key facts

- The International Fire Code keeps recreational fires 25 feet from any structure or combustible material, and asks that anything that could carry a fire within that distance be removed before you light it.[^1]
- Wheeling treats fire pits as accessory structures, sets 6-foot side and rear setbacks and a 10-foot separation from the house, and does not allow them in utility or drainage easements.[^3]
- In Portage, a pit closer than 25 feet to a property line requires written approval from the neighboring property owner, and the permit holder must deal with complaints about heavy smoke, odors or floating debris.[^2]
- Yorba Linda, California, wants a listed and labeled burner assembly with a specification sheet that states the maximum BTUs and the testing agency.[^5]
- Williamsport, Pennsylvania, allows charcoal or wood only and no household items such as paper, rubbish or garbage.[^6]

## Why do fire pit permits get refused?

A fire pit permit is checked by people looking at a site plan and, often, at your yard. These are the problems published city rules tell them to look for:

| Reason | What the rule says | Source |
| --- | --- | --- |
| Too close to a structure | No recreational fire within 25 feet of a structure or combustible material (IFC 307.4.2) | Price City, Utah[^1] |
| Inside a setback | 6 ft from side and rear lines, 10 ft from the house, 25 ft from the street side on a corner lot | Wheeling, Illinois[^3] |
| In an easement | Fire pits are accessory structures and are not permitted within utility or drainage easements | Wheeling, Illinois[^3] |
| Under branches | No fire pits under low-hanging branches or other combustible materials | Portage, Michigan[^2] |
| Too big | Fire pits no more than 3 feet across | Portage[^2]; Murray City, Utah[^7] |
| Gas information missing | A gas piping schematic with every appliance's BTU rating and every pipe's length, size and material | Broomfield, Colorado[^4] |
| Unlisted burner | Burner assembly must be listed and labeled, with a specification sheet | Yorba Linda, California[^5] |
| Wood where wood is banned | Wood burning fireplaces and pits prohibited by SCAQMD Rule 445 | Yorba Linda, California[^5] |

## 1. The 25-foot circle

Most refusals start with a tape measure. The International Fire Code keeps recreational fires 25 feet from any structure or combustible material, and asks that anything that could carry a fire within that distance be removed before you light it[^1]. Portage, Michigan, applies the same 25 feet to all structures by city ordinance and inspects the site before issuing a permit[^2].

"Structure" is wider than "house". Wheeling, Illinois, lists buildings, decks and fences among the structures a portable fire pit must stay 15 feet from[^3]. A pit placed neatly in the middle of a small yard can still be 12 feet from a cedar fence, and that alone sinks the application.

## 2. Setbacks and easements

A permanent fire pit is a structure on your lot, so zoning applies. Wheeling treats fire pits as accessory structures, sets 6-foot side and rear setbacks and a 10-foot separation from the house, and does not allow them in utility or drainage easements[^3]. Easements are often invisible in the yard and only appear on the plat of survey, which is why Wheeling asks for the survey with the pit drawn on it[^3].

## 3. The neighbors

Some rules give your neighbor a direct say. In Portage, a pit closer than 25 feet to a property line requires written approval from the neighboring property owner, and the permit holder must deal with complaints about heavy smoke, odors or floating debris[^2]. A permit can also be renewed without a new inspection only if no complaints were received during the previous two-year period[^2].

## 4. Gas fire pits with missing paperwork

Gas fire pits fail on paperwork more often than on placement. Broomfield, Colorado, asks for a schematic of the gas piping showing all other gas appliances, the BTU input rating of each, and the length, size and material of every pipe between the meter and the new appliance; it uses that drawing to size the pipe correctly without affecting existing gas outlets[^4]. Yorba Linda, California, wants a listed and labeled burner assembly with a specification sheet that states the maximum BTUs and the testing agency[^5]. An application without these documents cannot be checked, so it comes back.

At inspection, a gas line can still fail. Broomfield requires a 10 psi pressure test held for at least 10 minutes, and the pipe must be inspected before it is buried or concealed[^4].

## 5. Walls and extras nobody mentioned

The pit may be fine and the seating is not. Yorba Linda requires a permit and inspections, including footings and framing or rebar, for any framed or masonry wall 3 feet or more in height, and separate inspections for gas, water, electrical and drainage lines[^5]. A built-in barbecue or an outdoor fireplace next to the pit brings its own requirements, such as chimney height rules for gas outdoor fireplaces[^5].

## 6. The fuel itself

In parts of Southern California, wood is off the table. Yorba Linda states that wood burning fireplaces and pits are prohibited by South Coast Air Quality Management District Rule 445[^5]. A plan that shows a wood-burning pit there has nothing to approve. Elsewhere, fire departments restrict what you burn: Williamsport, Pennsylvania, allows charcoal or wood only and no household items such as paper, rubbish or garbage[^6].

## What happens if you skip the permit

Fire codes are enforced quickly because a fire is visible. In Portage, a violation can get the fire extinguished and a civil citation issued[^2]. In Williamsport, citations range from $75 to $300, and a fire that firefighters judge to be a public nuisance after a complaint is put out[^6]. In Murray City, Utah, violators may be prosecuted with a Class A, B or C misdemeanor[^7].

A permanent pit has a longer tail: it stays with the house. If the gas line was never pressure tested and inspected, there is no record that it was.

## How to avoid a refusal

1. **Start from the survey.** Draw the pit, its 3-foot fire area and the 25-foot circle on your plat of survey before you buy materials.
2. **Check the three offices.** Building department (structure, walls), fire department (burning), and the gas inspection, if any.
3. **Collect the documents the city names.** Specification sheets for manufactured units and burners, construction plans for a built pit, a gas line diagram[^3][^4].
4. **Book the inspections in the right order.** Gas piping before burial, footings before concrete, final before the first fire[^3][^4].

That is the file we prepare. The **All-in, until approved** offer ($399) includes the rules for your address, a site plan with the distances your city checks, drawings, forms, a review before you file and our follow-up on each city comment until the permit is issued. If your city refuses the permit for a written requirement we should have caught, the [money-back guarantee](https://yespermit.com/guarantee/) applies.

## Common questions

### Why would a city refuse a fire pit permit?

Published city rules point first to where the pit is - closer than 25 feet to a structure, inside a side or rear setback, in a utility or drainage easement, or under low branches. They also name pits wider than 3 feet and gas lines without a piping diagram or a listed burner.

### Can my neighbor stop my fire pit?

In Portage, Michigan, a fire pit closer than 25 feet to a property line needs the neighboring owner's written approval. In several cities, a fire whose smoke becomes a nuisance after a complaint must be put out.

### What happens if I use a fire pit without a permit?

In Portage, Michigan, the fire can be extinguished and a civil citation issued. Williamsport, Pennsylvania, lists citations from $75 to $300. Murray City, Utah, says violators may be prosecuted with a Class A, B or C misdemeanor.
