# Why driveway permits get rejected

Driveway and curb cut permits are refused for a few recurring reasons: the curb cut is too wide or too narrow, too close to a corner or to another driveway, the lot already has the curb cuts it is allowed, the driveway breaks the zoning width, setback or surface rules, or the plan ignores sight distance and drainage on the street.

## Key facts

- Santa Fe, New Mexico, requires residential curb cuts between 12 and 22 feet wide.[^1]
- On the lot itself, Cleveland Heights, Ohio, limits a driveway serving a garage to 12 feet, with a wider apron allowed for 20 feet in front of the garage doors before it tapers back to 12 feet.[^2]
- Seattle checks the width, location and number of curb cuts allowed against its land use code before it issues a curb cut permit.[^3]
- PennDOT reviews the driveway location for sight distance, drainage and the proposed design, and says the review exists to avoid costly problems such as relocating the driveway later.[^4]
- Salina, Kansas, requires a concrete paved approach for a garage accessed directly from the street, and right-of-way concrete work needs a separate permit from its engineering division.[^5]

## Why do driveway permits get rejected?

A driveway permit is reviewed by people who think about the street: traffic engineers, public works inspectors and zoning staff. They are not judging your paving; they are checking where the car will cross the sidewalk and enter traffic. Applications come back for the reasons below, each matched to a published rule.

## 1. The curb cut is the wrong width

Cities set both a minimum and a maximum. Santa Fe, New Mexico, requires residential curb cuts between 12 and 22 feet wide[^1]. On the lot itself, Cleveland Heights, Ohio, limits a driveway serving a garage to 12 feet, with a wider apron allowed for 20 feet in front of the garage doors before it tapers back to 12 feet[^2]. A drawing that runs a double-wide slab all the way to the street fails both kinds of rule.

## 2. It is too close to the corner

On a corner lot, the driveway is pushed away from the intersection. Santa Fe requires residential curb cuts to be no closer than 10 feet from the property line of the intersecting street, and does not allow the driveway to encroach on the corner curb return[^1]. On a small corner lot, that can leave only one place where a driveway is possible.

## 3. Too many curb cuts, or too close together

A second driveway is the classic refusal. Santa Fe requires at least 25 feet of standing curb between any two cuts[^1]. Seattle checks the width, location and number of curb cuts allowed against its land use code before it issues a curb cut permit[^3].

## 4. It breaks the zoning rules on your lot

The part of the driveway on private land is a zoning matter, and the rules are specific[^2]:

- **Too close to the lot line**: Cleveland Heights requires driveways at least 3 feet from the side and rear lot lines; a shared driveway on the line is allowed only if both owners agree.
- **The wrong surface**: gravel and wood chips are prohibited there.
- **Too much paving**: semi-pervious paving is encouraged, but it is still subject to the coverage requirements of each yard.

## 5. Sight distance and drainage on the street

On state highways, the review goes further. PennDOT reviews the driveway location for sight distance, drainage and the proposed design, and says the review exists to avoid costly problems such as relocating the driveway later[^4]. A driveway at the crest of a hill or at the inside of a curve can be refused where the same driveway would pass on a straight road.

## 6. Built to the wrong standard at the street

The apron must meet the city's own construction standard. Salina, Kansas, requires a concrete paved approach for a garage accessed directly from the street, and right-of-way concrete work needs a separate permit from its engineering division[^5]. Cleveland Heights requires residential aprons of concrete at least 6 inches thick[^2]. An application that shows asphalt or thin concrete in the right-of-way will be sent back.

## 7. The drawing is not enough

Santa Fe asks for an accurate drawing of the driveway with respect to the public right-of-way, plus the legal plat of survey showing any easements[^1]. A phone photo with arrows does not show the width at the curb, the distance to the corner or the easements, so the review cannot start.

## What an unpermitted driveway can cost

The curb belongs to the city or the state, so the consequences are direct:

- **A fine and a rebuild on a state highway**: in Pennsylvania, building a new driveway or altering an existing one onto a state highway without a permit means a minimum $100 fine plus court costs, and more if the driveway was installed improperly and must be corrected by the owner or PennDOT[^4].
- **Reconstruction at your expense**: Santa Fe can revoke the permit and require any nonconforming driveway to be rebuilt to city standards at the owner's expense[^1].
- **Daily charges**: Wharton, Texas, lists a fee of $100 per day for working without a permit[^7].
- **Paying again for a curb cut**: in Salem, Virginia, the 2025-2026 rate for a driveway or crossover is $150 per linear foot, payable in advance[^6], so a curb cut that has to be moved is not a small correction.
- **It stays with the house**: Fairfax County, Virginia, applies its rules on unpermitted construction to properties that were bought and sold, regardless of when the work was done[^8].

## How to avoid a refusal

Every rule above can be checked before you file: the width at the curb, the corner distance, the spacing from the next driveway, the setbacks, the surface and the apron standard. Our All-in offer prepares that drawing and the application with the rules for your address, and follows it until the permit is issued.

## Common questions

### Can I have two driveways?

Sometimes, but cities limit the number and spacing of curb cuts. Santa Fe, New Mexico, requires at least 25 feet of standing curb between two curb cuts, and Seattle checks the number of curb cuts allowed on a lot against its land use code.

### Why can't I widen my driveway?

Because width is a zoning rule. Cleveland Heights, Ohio, limits a driveway serving a garage to 12 feet, with a wider apron only in front of the garage doors, and Santa Fe caps residential curb cuts at 22 feet.

### What happens if I built a driveway without a permit?

You may be fined and asked to rebuild it to the standard. PennDOT sets a minimum $100 fine plus court costs for a new or altered driveway onto a state highway without a permit, and Santa Fe can require a nonconforming driveway to be rebuilt at the owner's expense.

### Can I reapply after a refusal?

Usually yes. Most refusals ask for a narrower cut, a different location or another surface. Change the drawing and resubmit; a rule you cannot meet, such as the corner distance on a small lot, may need a variance where your city allows one.
