# Why bathroom remodel permits get rejected

Bathroom remodel permits are sent back when plans are missing for a layout change, a load-bearing wall moves without calculations, or the drawings miss a code requirement such as shower size, toilet clearances, GFCI outlets, a humidity-controlled fan, tempered glass or smoke and carbon monoxide alarms. Inspections fail when work is covered before the rough inspection.

## Key facts

- Pleasanton requires an existing floor plan with every plumbing fixture, wall, door and window, and a proposed floor plan with the new layout, plus a cover sheet with the scope of work and the applicable codes.[^1]
- Sacramento lets in-kind replacements go without plans, but creating or relocating openings in the bathroom's perimeter walls triggers a complete plan review.[^3]
- Santa Clarita requires rough inspections of framing, electrical, plumbing, gas and mechanical work before they are covered or concealed, and a final inspection when the work is finished.[^5]

## Why do bathroom remodel permits get rejected?

A bathroom is small, but its plan check is dense: plumbing, electrical, ventilation, glazing and safety rules all meet in a few square feet. Most rejections are correction lists, each item tied to a code section. These are the ones that come back most, from published city handouts.

| Reason | The rule | Example |
| --- | --- | --- |
| No plans for a layout change | Existing and proposed floor plans | Pleasanton[^1]; Hayward: drawings for every remodel[^2] |
| Load-bearing wall moved | Structural calculations | Pleasanton[^1]; Hayward[^2] |
| Shower too small | 1,024 square inches, 30-inch circle | Pleasanton[^1]; Sacramento[^3] |
| Toilet too tight | 15 inches to the side, 24 inches in front | Hayward[^2]; Laguna Hills[^4] |
| Outlets and circuit | GFCI, tamper-resistant, 20-amp circuit | Hayward[^2]; Sacramento[^3] |
| Exhaust fan | Humidity control, 50 cfm, outside, damper | Hayward[^2]; Laguna Hills[^4] |
| Glass near the tub | Tempered glass | Pleasanton[^1] |
| Alarms missing | Smoke and carbon monoxide alarms | Pleasanton[^1]; Hayward[^2] |
| Walls closed too early | Rough inspections first | Santa Clarita[^5] |

## The rules behind most rejections

### No plans, or the wrong plans

When the layout changes, the city wants to see before and after. Pleasanton requires an existing floor plan with every plumbing fixture, wall, door and window, and a proposed floor plan with the new layout, plus a cover sheet with the scope of work and the applicable codes[^1]. Hayward requires drawings for every bathroom remodel[^2]. Sacramento lets in-kind replacements go without plans, but creating or relocating openings in the bathroom's perimeter walls triggers a complete plan review[^3].

### Structure without calculations

Removing or altering a load-bearing wall needs structural calculations from a qualified design professional showing a continuous load path in Pleasanton, and so does a curbless shower that recesses the floor framing[^1]. Hayward notes that structural plans and calculations may be required for removing or replacing load-bearing walls[^2].

### The shower

Shower rules are precise. Pleasanton requires at least 1,024 square inches of finished interior with room for a 30-inch circle, a door that swings out with a clear opening of at least 22 inches, a pan or site-built watertight liner extending 3 inches up the walls and sloped toward the drain, and walls finished with a nonabsorbent surface at least 6 feet above the floor[^1]. Hayward and Sacramento allow an exception when an existing bathtub is replaced by a shower receptor at least 30 inches wide and 60 inches long[^2][^3]. Without a curb, Hayward treats the entire bathroom as a wet location, with waterproofing for the whole floor and wet-location light fixtures[^2].

### Toilet and fixture clearances

Toilets must be at least 15 inches from their center to any side wall or obstruction, 30 inches center to center from a similar fixture, with at least 24 inches of clear space in front, in Hayward[^2]; Laguna Hills lists the same 15 and 24 inch rules[^4]. Moving a vanity a few inches can break them.

### Electrical

Hayward requires every new bathroom receptacle to be GFCI-protected and tamper-resistant, a dedicated 20-amp circuit when outlets are added, and receptacles within 36 inches of the sink edge[^2]. Sacramento adds that the bathroom receptacle circuit cannot supply other outlets, lights or fans, except equipment in the same single bathroom, and that receptacles cannot sit inside a tub or shower space[^3]. Laguna Hills prohibits electrical fixtures within 3 feet horizontally and 8 feet above a tub or shower, and requires damp-rated recessed lights there[^4].

### Ventilation

Hayward requires a humidity-controlled exhaust fan rated at 50 cfm, switched separately, with a backdraft damper and an exhaust point at least 3 feet from a property line or any opening into the building[^2]. Laguna Hills requires an ENERGY STAR fan with humidity control[^4].

### Glass and alarms

Pleasanton requires tempered glass, with a visible permanent safety label, for any window within 60 inches of a tub or shower whose glass is less than 60 inches above the floor[^1]. Smoke and carbon monoxide alarms must be installed in the required locations before final inspection in Pleasanton[^1], and in Hayward when the value of the work exceeds $1,000[^2].

### Water-saving fixtures in California

California handouts check fixture flow rates: Sacramento lists 1.28 gallons per flush for toilets, 1.2 gallons per minute for lavatory faucets and 1.8 gallons per minute for showerheads[^3].

## Failed inspections

A permit can be approved and the project still fail on site. Santa Clarita requires rough inspections of framing, electrical, plumbing, gas and mechanical work before they are covered or concealed, and a final inspection when the work is finished[^5]. Tiling over a wall before the rough plumbing inspection is the classic mistake: the inspector cannot see what the tile hides.

## What happens without a permit

- **Plumbing and wiring always count.** Even under Florida's new exemption for small projects under $7,500, Miami-Dade notes that electrical, plumbing and mechanical work always require permits[^6].
- **Higher fees.** Lower Salford Township, Pennsylvania, doubles its fees if work begins without an approved permit in hand[^7].
- **A penalty to legalize.** In New York City, legalizing work done without a permit on a one- or two-family home carries a $600 civil penalty[^8].
- **The sale.** Washington's seller disclosure statement asks whether there have been any conversions, additions or remodeling and whether all building permits and final inspections were obtained[^9].
- **A stop work order.** In Santa Clarita, work that continues after a stop work order exposes the owner to fines and a lien on the property[^5].

## How to get it approved the first time

1. Decide whether the layout changes; that decides whether you need plans[^1][^3].
2. Draw the existing and proposed floor plans with every fixture[^1].
3. Check the shower size and toilet clearances on the plan, not on site[^1][^2].
4. Show the outlets, circuit, fan and lighting[^2].
5. Mark tempered glass and the alarm locations[^1].
6. Book the rough inspections before you close the walls[^5].

## Common questions

### Why was my bathroom permit sent back for plans?

Because the layout changes. Pleasanton, California, accepts like-for-like remodels without plans, but requires an existing and a proposed floor plan when fixtures are relocated or added or walls are removed, and Hayward, California, requires drawings for every bathroom remodel.

### What is the minimum shower size?

In the California handouts we checked, a shower needs at least 1,024 square inches of floor and room for a 30-inch circle, with a door opening of at least 22 inches. Hayward and Sacramento allow an exception when an existing tub is replaced by a shower at least 30 by 60 inches.

### How much space does a toilet need?

Hayward and Laguna Hills, California, require at least 15 inches from the center of the toilet to a side wall or obstruction and at least 24 inches of clear space in front of it.

### Why did my inspection fail?

Often because the walls were closed too early. Santa Clarita, California, requires rough inspections of framing, electrical, plumbing and mechanical work before they are covered or concealed.
