# Basement finishing permits, explained

Finishing a basement needs a building permit in many places: Fairfax County, Virginia, and Monticello, Minnesota, both say so. Paint, carpet and cabinets alone are exempt under the International Residential Code, but new walls, bedrooms, bathrooms and wiring are not. Expect to submit a scaled floor plan with window sizes, then pass inspections.

## Key facts

- Section R105.2 of the International Residential Code (IRC) exempts painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work from a building permit.[^1]
- Monticello asks for neat scale drawings with a floor plan, window sizes and locations, cross sections and notes on the extent of the project.[^2]
- Salina requires at least 7 feet in habitable spaces, hallways, bathrooms, toilet rooms and laundry rooms, 6 feet 8 inches in the parts of the basement without them, and lets beams, girders and ducts project down to 6 feet 4 inches.[^3]
- For an 800-square-foot basement, that is $120 in Jerusalem and $240 in Canandaigua.[^7][^8]
- The City of Castle Pines puts it plainly: homeowners insurance policies may not pay for damages caused by work done without permits and inspections, and when you sell, you may be required to tear out the work, leave it unoccupied or make costly repairs.[^4]

## Do you need a permit to finish a basement?

Start from what is exempt. Section R105.2 of the International Residential Code (IRC) exempts painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work from a building permit[^1]. If you are only painting the walls and laying carpet, that list covers you.

A basement finish is rarely that. As soon as you build walls, add a bedroom, a bathroom or circuits, cities expect a permit:

| Where | What the city says | Source |
| --- | --- | --- |
| Monticello, Minnesota | A building permit is required to finish a basement or change the use of a space, such as a recreation room into a bedroom | [^2] |
| Fairfax County, Virginia | Finished basements and changes to walls are among the common projects that need permits | [^5] |
| Fairfax County, Virginia (2026) | The Virginia Construction Code requires permits for finishing basements | [^9] |
| Salina, Kansas | A scaled floor plan and the names of the licensed contractors are needed before the permit can be reviewed | [^3] |
| Castle Pines, Colorado | Permits are required by ordinance; work without a permit may be subject to removal | [^4] |

The trades come on top. In Monticello, electrical work needs a separate permit from the Minnesota Department of Labor and Industry, applied for online, and is inspected by a state electrical inspector[^2]. The IRC exemption list also stops short of most plumbing: stopping leaks is exempt, but replacing a concealed pipe is not[^1].

## What the city asks for

The application is a floor plan, drawn to scale. Monticello asks for neat scale drawings with a floor plan, window sizes and locations, cross sections and notes on the extent of the project[^2]. Salina wants the floor plan to show room sizes and uses, existing finished areas, stairs, egress windows, the furnace and water heater, plumbing fixtures, and every new and existing window and fixture[^3].

Castle Pines adds practical details that reviewers look for[^4]:

1. Label the use of every room and distinguish existing from new, and finished from unfinished.
2. Show outlets, smoke detectors, lighting, fans, plumbing changes, cleanouts, the furnace and the water heater, and say whether each appliance is gas or electric.
3. List window sizes and types and identify the emergency escape windows.
4. Show any change to posts, beams and floor joists.
5. Mark dropped-ceiling areas under 7 feet.
6. Show the clearances around the tub and fixtures.

## The rules your plans must show

Most of a basement review comes down to five safety rules. The figures below are the ones these cities publish; your city's own code is the one that applies.

### An emergency escape opening

Basements and each sleeping room need an emergency escape and rescue opening that opens to a yard or court leading to a public way (IRC R310)[^2]. Monticello lists the dimensions: at least 5.7 square feet of net clear opening, at least 24 inches of clear height and 20 inches of clear width, and a sill no more than 44 inches above the floor[^2]. Using both minimums is not enough: a 20 by 24 inch opening is only 3.3 square feet, so a 20-inch-wide window needs a clear opening of about 41.04 inches high, 42 inches in practice[^2].

Below grade, the window well matters too: Monticello requires at least 9 square feet of well area, with a horizontal projection and width of at least 36 inches, and an attached ladder or steps when the well is deeper than 44 inches[^2].

### Ceiling height

Salina requires at least 7 feet in habitable spaces, hallways, bathrooms, toilet rooms and laundry rooms, 6 feet 8 inches in the parts of the basement without them, and lets beams, girders and ducts project down to 6 feet 4 inches[^3]. Monticello sets 6 feet 4 inches as the minimum in existing basements, including under beams, ducts and other obstructions[^2]. Castle Pines asks you to consult the building department if the finished ceiling will be under 7 feet[^4].

### Smoke and carbon monoxide alarms

Salina requires smoke detectors in each bedroom, in the hallway outside the bedrooms and on every floor, basement included, and carbon monoxide alarms outside each sleeping area[^3]. Castle Pines requires new smoke alarms to be hard-wired with battery backup and interconnected with the existing ones[^4].

### Bedrooms

Monticello requires a bedroom of at least 70 square feet and at least 7 feet in any horizontal dimension, with its own escape opening[^2]. Gas furnaces and water heaters cannot be in a bedroom, bathroom or storage closet in Monticello[^2], and Salina does not allow them to be reached through a bedroom, bathroom or closet unless they are direct-vent units[^3].

### Fire blocking and insulation

Fire blocking goes in concealed wall spaces at the ceiling and floor levels and at intervals of no more than 10 feet horizontally (IRC R302.11)[^2]. Foam plastic insulation must be covered with 1/2 inch drywall or another approved material (R316.4)[^2]. Walls resting on the concrete floor need a pressure-treated bottom plate[^3].

> **Where we stop**
> We draw the floor plan, the window schedule and the notes your city asks for. If your project removes or changes a load-bearing wall, Monticello wants a header or beam detail with the application[^2], and drilling engineered beams or open-web trusses needs the manufacturer's or an engineer's design[^2]. We tell you when that is the case, at the start.

## The inspections

Monticello inspects all work, gives an inspection record card with the permit that lists the required inspections, and asks for 24 hours' notice[^2]. Plan the order: the framing, wiring and plumbing must be seen before the drywall goes up.

## What a basement finishing permit costs

| Where | Fee | Source |
| --- | --- | --- |
| Oakdale, Minnesota (2025) | $160 flat for a basement finish, up from $155 in 2024; electrical for remodels or basement finishes $100, with 2 inspections and up to 10 circuits | [^6] |
| Jerusalem, New York (2026) | Remodeling $0.15 per sq ft, $50 minimum | [^7] |
| Canandaigua, New York (2026) | Renovation $0.30 per sq ft, $100 minimum | [^8] |

For an 800-square-foot basement, that is $120 in Jerusalem and $240 in Canandaigua[^7][^8]. In Oakdale, the electrical permit fee is doubled if the work starts before the permit is issued[^6].

## How long it takes

Monticello estimates 5 business days to process a complete application, and says an incomplete one takes longer[^2]. Salina asks for 3 to 5 working days for its review[^3]. Both point to the same thing: the review is short when the floor plan already answers the reviewer's questions.

## Finishing without a permit

The City of Castle Pines puts it plainly: homeowners insurance policies may not pay for damages caused by work done without permits and inspections, and when you sell, you may be required to tear out the work, leave it unoccupied or make costly repairs[^4]. In Fairfax County, unpermitted construction is a violation; the owner must get the permits and inspections or remove the work, and the county may ask the courts for fines or an order[^9]. Its rules also apply to homes that changed hands, whatever the date of the work[^5].

## Your basement permit file

A basement permit file is a floor plan with every room labeled, the window and egress details, the alarms, the ceiling heights and the notes your city's handout asks for. Our Permit Kit prepares it from your city's own rules. The All-in offer adds the review before filing and follows each city comment until the permit is approved.

## Common questions

### Do I need a permit to finish my basement?

In many places, yes. Monticello, Minnesota, requires a building permit to finish a basement or change the use of a space, such as turning a recreation room into a bedroom. Fairfax County, Virginia, lists finished basements among the common projects that need a permit. Finish work alone, like painting, carpet or cabinets, is exempt under the International Residential Code.

### Does a finished basement need an egress window?

Under Section R310 of the International Residential Code, basements with habitable space and every sleeping room need an emergency escape and rescue opening. Monticello, Minnesota, summarizes it as at least 5.7 square feet of net clear opening, at least 20 inches wide and 24 inches high, with a sill no more than 44 inches above the floor.

### How low can a basement ceiling be?

Salina, Kansas, requires at least 7 feet in habitable spaces, hallways, bathrooms and laundry rooms, 6 feet 8 inches in the other parts of a basement, and allows beams and ducts down to 6 feet 4 inches. Monticello, Minnesota, gives 6 feet 4 inches as the minimum in existing basements, including under beams and ducts. Your city's rule is the one that counts.

### Can I do the work myself?

Often yes. Salina, Kansas, lets an owner-occupant do their own work, including electrical, plumbing and mechanical work, while anyone hired must hold the right city license. In Minnesota, electrical work needs a separate permit from the state's Department of Labor and Industry.

### Is the city's permit fee included in your price?

No. The permit fee is paid to your city or county. Your permit file shows the fee from its published fee schedule, with the link, before you file.
